Divorce
Divorce is a legal process used to end a marriage and determine the division of property acquired during the marriage, child custody, child support, alimony, division of debt and attorney fees and other costs.
A divorce begins with a complaint or petition being filed in the superior court where, in most circumstances, the defendant lives. Once a complaint is filed the other party has 30 days to file a response, and both parties are free to participate in the discovery process according to state law.
Discovery is the legal procedure whereby each spouse obtains information about the other: each spouse is entitled to information about the other including bank account records, tax returns, other tax documents, retirement accounts, email records, and almost any other record or document created about you and your spouse during your marriage. Lawyers can use interrogatories (written questions answered under oath), depositions (the process whereby an attorney asks questions of the other party in front of a court reporter) and requests for production of documents among other discovery devices.
At Fox Legal we will guide you through each step of the process and answer each and every question you have along the way.
Divorce can be difficult, even in the most amicable of break-ups, but it does not have to be devastating. Often ex-spouses must continue to work with each other on parenting and finances, especially when there are children involved. Fox Legal will work with you to provide honest representation of your interests so that you and your spouse can move forward with separate lives without ruining the loving relationships between you, your children and the rest of your family.
Often the most difficult part of a divorce is determining how child custody and parenting time will be divided between two loving and caring parents.
There are rarely “winners” in custody battles. Parents and grandparents benefit from ethical representation by an attorney who seeks to minimize the toll a divorce takes on children to preserve the loving relationships children have with their parents and grandparents. A successful custody case is one that does not involve a judge making a decision, but focuses on the best interest of the children at all times.
Courts are laser-focused on the best interest of the children and not on the desires of parents. Our goal at Fox Legal is on working with each unique client to craft parenting plans and agreements that meet the needs of our clients and their children.
Each case is different so each plan and each approach to parenting time and custody is different. We will listen to your ideas and your family’s needs and work with you to craft a parenting plan that fits your family’s situation and is within the bounds allowed by law.
The difficulty of divorce is only eclipsed by the cost of divorce.
In almost every custody case one party will pay support to the other for the care of the children. Alimony is not guaranteed in every case and depends on a number of factors.
At Fox Legal we will work with you on issues of support, alimony and other economic factors involved in divorce so that support is ordered in a truly equitable manner, and the orders of the court or settlement orders are manageable over the course of a lifetime rather than simply working toward short-term goals.
Pre-Nuptial Agreements are hopeful documents. Brides and grooms usually are not thinking about divorce when they consider marriage, but many marriages do end in divorce.
Couples where one or both parties have been through one divorce should strongly consider using a pre-or post-nuptial agreement and anyone contemplating marriage would be wise to work with an attorney to agree on how economic and other issues will be settled in the unfortunate event of a divorce.
Pre-Nuptial Agreements help parties to amicably agree on terms before anger and other unhelpful emotions can become involved. We can help you preserve wealth prior to a divorce and provide for equitable property distributions and support via a pre-or post-nuptial agreements. It’s not the most romantic of conversations, but it may be the one that preserves your livelihood and maybe your marriage in the end.
Mediation is often the best way to solve the problems inherent in divorce: emotional rather than legal issues often tend to rule the day and Mediation can offer a realistic and holistic approach to creating solutions to these problems for the entire family. In Mediation the parties meet with a neutral person whose role is to help them reach an agreement on all or some of the issues in their divorce so as not to go to court where a judge will determine the outcome with reference only to the law, and not to emotional or other issues. You should be represented by an attorney in mediation and you should expect a mediator to challenge your ideas about what is “fair” or “equitable” on the road to crafting a good settlement.
Sally C. Fox represents clients in mediation and is a registered neutral with the State of Georgia Office of Alternative Dispute Resolution and is available to mediate cases where both parties are represented by their own counsel.
Guardians ad Litem serve an important and special function in custody cases: they are appointed by the Court to investigate issues involved in custody and parenting time disputes. Sally has served as a GAL in custody cases and is available to work with lawyers to thoroughly investigate and make recommendations in any custody case in the Metro area.
What happens if I move?
What happens if I earn more (or less) money or lose my job?
What if my children tell me that they do not want to visit with their mother (or father)?
What if something changes?
What do we do in the future if all we have is an agreement that sorts things out now?
These are common questions by parties in a divorce proceeding. We do our best to draft agreements and orders that are forward-thinking and provide for any contingency, but at Fox Legal we are lawyers, and we are not clairvoyant: no one can predict the future.
The law provides for making changes to custody and support agreements within reason, and based on certain factors. We will discuss your unique situation with you to determine whether a change is necessary and how best to make it happen without breaking the bank.
